The Austrian Mafia #9: Lyoness' attack on Wikipedia

It is one of the most beautiful initiatives in the world: Wikipedia, the free encyclopedia. Set out to educate the world population in every available language, on every possible subject, independently of any other organisation or individual, and completely free of charge, Wikipedia has rapidly become one of the most respected websites on the internet and a 'go to' source for nearly everyone seeking (basic) information on nearly everything.

Although it has taken quite a while, recently, we were happy to report that Lyoness was no longer hidden on Wikipedia behind a 'redirect' to the mythological land of 'Lyonesse', from which the name 'Lyoness' was directly derived, but that 'the world's largest shopping community' had finally gotten its very own article on the world's largest encyclopedia.

However, we are reliably informed that a user by the name 'LyoNewMedia' has been trying to delete or alter vital parts of the article, as well as to diffuse part of the truth on Lyoness. As reported by the main contributor to the Lyoness Wikipedia article, 'Lyoness Expert', 'LyoNewMedia' has even succeeded to have the Wikipedia community remove the references in the article pointing to the excellent Blog of mr. David Brear and his articles on the Lyoness racket. According to our own investigations, 'LyoNewMedia' has been trying to pull off the same the tricks on the German version of Wikipedia, where this user is one of the main contributors on the Lyoness article.

Although the Complaint Centre Lyoness greatly values neutrality, objectivity and open-access, it should not be the case that the Lyoness racketeers get granted permission to write their own 'truth' on Wikipedia, whilst isolating the millions of interested people all around the globe from the actual truth. We therefore appeal to the good sense of the Wikipedia community to disallow this obvious puppet account of Lyoness to change anything in the Lyoness article, as this obviously violates all pillars Wikipedia was built on in terms of Wikipedia being unbiased, neutral and objective.

Another important question to consider is why Lyoness is so keen on altering and hiding the truth. Do they have more to hide than they previously claimed? Does the Blog of mr. David Brear out too many of their well-hidden secrets?

Luckily, Lyoness' attack on Wikipedia has not stopped the efforts of others to publish Wikipedia articles in other countries. Next to the Swedish Wikipedia page that popped up earlier, now we have been informed that Lyoness is featured on the Spanish Wikipedia too.

The Austrian Mafia 8: Lyoness sues attorney Eric Breiteneder

After the (partial) 'success' of Lyoness' civil suits against the founders of Plattform Lyoness, through which it forced Plattform Lyoness to change the name of its domain and remove legal documents from its website, Lyoness seeks to employ the same strategy to fight off other regular critics with the same means.

The Austrian newspaper Kurier reported that Lyoness has started legal proceedings against Eric Breiteneder, attorney at law. As most readers of this Blog know, Breiteneder is the main legal opponent of Lyoness in Austria, is representing about 220 Lyoness victims in their struggle for financial retribution, and has won most court cases for his clients - and has thus succeeded in getting their money back.

In a complaint to the Austrian attorney association and a civil lawsuit filed in Vienna, Lyoness claims that Breiteneder has organised information meetings to instruct Lyoness victims to lie in front of court, by saying that they did not clearly understand the 'position system' when investing in Lyoness and that they were falsely informed that they could redeem their investment at any point. As everyone knows, these claims are factual.

Another part of the same complaint focuses on a meeting Breiteneder had with a client about three months ago. 'Coincidentally', an attentive listener overheard Breiteneder 'instruct his client to lie in court'. The 'attentive listener' is now testifying on Lyoness' behalf. Although a testimony about an event that transpired more than three months ago may not be considered very reliable by the Austrian judges, Lyoness claims to have tape recordings of the incidents. We find it very surprising that a 'coincidental attentive listener' carries around a tape recorder, just in case.

Of course, Lyoness has no case here. It is completely normal that an attorney instructs clients on what to say in court. Moreover, the instructions given by Breiteneder have a solid foundation in quantifiable evidence. That is more than we can say about Lyoness' absurd claims.

Readers should note that the Austrian Consumer Union (VKI) contests 61 clauses of the Lyoness terms and conditions in court for their vagueness, opaqueness and incomprehensibility. Furthermore, the position system is an obvious pyramid scheme.

Breiteneder himself does not take the matter up lightly, even though he considers the complaint and court case to be mere attempts to silence and get rid of a nasty opponent. Breiteneder is at the moment active in more than twenty court cases against Lyoness. This seems a lot like 'revenge'.

"This is strong stuff. It brings a new dimension to the debate if a party starts spying on lawyers in private conversation with clients.[...] If I can not recommend a client, as provides his facts to the court, then the concept of legal advice falls apart."

Lyoness has issued a press release in which Mathias Vorbach, Lyoness' spokesman, explains the 'company's' new strategy:

"Suspecting him of continuously influencing court testimonies, Lyoness Europe AG took legal action against attorney Eric Breiteneder in Vienna this week. Moreover, the facts have been submitted to the attorney association in request of disciplinary action against him. Lyoness has entrusted the Viennese law firm Gheneff, Rami and Sommer to protect its interests.

Lyoness accuses Breiteneder of recruiting plaintiffs among the Lyoness participants that attend the information meetings he organises and persuading these plaintiffs to lie in court in order to provide Breiteneder with the verdict he is after. As evidence to support these complaints, the court has been provided with tape recordings of an example of Breiteneder's attempts to influence a plaintiff in April. In this case, Breiteneder cannot hide behind calling our recording 'spying on a confidential client conversation', as the media are now referring to this evidence - these were publicly advertised and accessible events.

"After two independent injunctions have strengthened the legal position of Lyoness, we now take action against the strategy to produce complaints using - in our opinion - illegal activities", says spokesman Mathias Vorbach. "For a long time, we have suspected that all this false information was deliberately disseminated. Now, it's time to put an end to that and inform the public about it."

So, what should one make of these developments? Are these proceedings and complaints a simple act of panic? Of course, it would not be the first time that Lyoness seems to act out of panic. Earlier, Lyoness flew Werner Kaiser (officially second in command at the headquarters in Switzerland/Austria) to London to calm down worried investors. In Australia, a similar meeting was held. Most recently, Freidl summoned his most faithful believers and extensively 'trained' them for 10 days in Austria.

Another, more probable option is that the Lyoness racketeers are busy setting up their new scam(s) and in the mean time, while transferring the assets to shell corporations owned by various jackstraws, want to prevent being financially drained by losing court cases and repaying its investors. It is also possible Lyoness wants to keep their investors around until the whole charade finally goes down the drain, and they will be offered to redeem their losses through a new, similar racket. In order to pull that off, Lyoness needs to keep up a strong attitude to preserve some of its rapidly tainting reputation.

On a similar note, we are very curious to find out what happened to Dr Peter Hauser, attorney of Bernhard Wagner (former managing director of Lyoness Bulgaria), who provided very intelligent and informed views on the Lyoness racket in the ORF Report episode on Lyoness. The website of his (former?) law firm HHS Law seems down and nearly nothing can be found about Dr Hauser on the internet anymore. If anyone knows anything about this, please contact us through the comment section of this Blog or through Twitter; @antilyoness.

FlexKom: the new Lyoness?

As more and more of our readers understand and accept that Lyoness is a pernicious lie, designed to scam millions of consumers and small and medium sized enterprises out of billions of euros, we are asked with an increased frequency what we think of other 'companies', operating similar 'business models'.

From the very start of the Complaint Centre, we have decided that our focus lays primarily on Lyoness. Whilst acknowledging that there is a long list of similar frauds operated at this time (usually with a differing disguise), we also acknowledge that others, with more experience and more knowledge on the subject, are better suited to provide a comprehensive overview of this type of scam. Therefore, for a full overview of the phenomenon of income opportunity racketeering, we would like to refer our readers to the excellent Blog of Mr David Brear.

However, every now and then a scam pops up and catches our attention, because it is just so darn similar to Lyoness. FlexKom is such a scam.

We have reported earlier that we expect the racketeers behind Lyoness to come up with a new front for their never-ending scam, much in the way like they have dealt with the problems faced earlier by GTS and Galvagin, which eventually produced Lyoness. From that perspective, we are inclined to investigate and report about scams that operate in a freakishly similar manner as Lyoness, with a near-identical disguise to cover up the fraud.

More and more readers have recently brought FlexKom to our attention, and have directed us to on-going debates on various internet fora (2, 3, etc), as well as social media, about FlexKom. For the readers who are unfamiliar with this name, we will provide a brief introduction of the 'company' below.

FlexKom is a 'company' founded, allegedly, in 2010, by either Cengiz Ehliz and/or Asker Sakinmaz, which are both presented as current CEO of the 'company', most probably because they are supposed to represent different divisions of the 'company'. It claims to be some sort of a franchise provider, supplying its partners (which pay about 1500 euros for a 'gold package') with the right to enrol shops into the network, sell them the special FlexKom machines (for about 400 euros), which functions as a reader for the FlexKom cards. The enrolled shops then have the right to issue FlexKom cards to their customers, with the promise that the cardholders will get discounts on their purchases at FlexKom-affiliated shops, and the shops are promised a percentage in commission over the purchases made by the cardholders at every FlexKom-affiliated company. Naturally, the earnings exponentially increase as soon as new partners and shops are brought in.

FlexKom, founded by people with a seemingly Turkish background, chose Turkey as its 'test-market', to see whether the system would function the way it was expected to. According to FlexKom, it did (which is why a long list of countries have now been 'opened' by FlexKom; i.e. FlexKom partners can now be signed up there). According to the Turkish partners, media and authorities, it did not.

We found it quite interesting to see that so much vagueness exists about this 'company', which self-reports to be an extremely reliable business partner. For instance, we have seen claims that this 'company' operated an MLM-system, as well as fanatical debates where FlexKom denies to have anything to do with MLM. The company appears to be Turkish, but is most often claimed to be from Germany - yet is registered in Switzerland. Also, many of the national divisions, presented as if they were incorporated and registered at the local chambers of commerce, are not findable in the company registers of these local chambers of commerce.

Both Cengiz Ehliz and Asker Sakinmaz are not officially attached to the Swiss corporation registered under the name 'FlexKom International Holding AG'. Instead, the two names currently attached to this holding (as managers and founders) are Hasan Süslu and Guido Gmür. About Süslu, nothing much is publicly available. About Gmür, however, one can find a little bit more. According to Moneyhouse, Gmür has worked for about 13 companies, amongst which is First Tax AG, registered on the same address as the FlexKom headquarters. Observant readers may remember that this is the company of which Lyoness co-founder and tax and bankruptcy expert Iwan J. Ackermann is the co-founder and CEO.

As we have argued earlier, the people behind Lyoness have previously been responsible for organising GTS (Erin Trade) and Galvagin - at least - and apparently managed to get away with running those scams by setting up shell corporations in various countries and moving assets around until they were no longer traceable for anyone looking for them. As it seems, this is the way they have managed to found Lyoness without anyone frowning upon the intentions of the Lyoness founders.

We understand that we should be cautious in what we write here, as the exact details and sequence of events are difficult to mimic, mainly due to the lack of information publicly available. However, it does look an awful lot like the same people that managed to transfer Galvagin into Lyoness, and continue their scam under a different name, are now in the process of doing the same for FlexKom. It definitely looks like FlexKom being the long-awaited successor of Lyoness, through which the people behind Lyoness can continue to the scam the world. If not, FlexKom is an extremely similar copy (again, there is 'cash back', the higher ranked adherents become first 'leaders' and then member of the 'President's Team', etc.) of the Lyoness racket and the people interested in running the FlexKom scam at least appear to have hired the same people to cover up their fraud.

It's all our fault...

Through the comments we have received from several severely deluded Lyoness members, we have understood that apparently it is not clear to all readers of our blog that the Lyoness racket is in the state of collapse.

If all the information we have uploaded here did not convince you, well, then let the Lyoness instigators tell it themselves:

"[The publishing of television episodes and other stories about Lyoness] may cause a mass exodus of customers, business partners and employees. There will be an irretrievable loss of confidence [in Lyoness] of customers, business partners and employees. Lyoness' economic reputation was permanently damaged by [Plattform Lyoness]."

What we don't understand is: how could 'a bunch of unsuccessful, anonymous losers with a free Blog that anyone could make', take down such 'a powerful, legitimate company, based on the pure power (through a brilliant, ingenious system) of never-ending consumption'? Maybe the system was not flawless after all?

No, that is of course a preposterous suggestion. Its imminent ruination cannot possibly be Lyoness' own fault - so it must be the sceptics', spreading 'filthy lies' about this Austrian masterpiece without allowing any of the poor masterminds behind it a chance to speak up for themselves and explain that we are completely wrong and out of line (probably they forgot that Vorbach had nothing to say about the ORF Report episodes, and that Freidl declined to comment entirely). Also, if anyone is disappointed, they must have been misinformed by a rogue distributor, who did not follow the guidelines and decided to deviate from the proven plan which guarantees success (in the form of financial freedom).

Readers of this Blog should be aware that this type of convulsions is common for a fraud that has had its best days. It's the fault of everyone, except the instigators or the system. If the Austrian authorities will move on a bit and finally forbid the Lyoness racket for what it is (and hold the responsibles to account) before it implodes and disappears into a new, copycat racket, it will definitely be the fault of the authorities - who 'robbed their citizens from the opportunity to be finally independent and fully happy and wealthy'.

Update: ORF Report now with Serbian subtitles too

After the struggle of keeping the ORF Report broadcast on Lyoness merely available on the internet, and after publishing the video with English subtitles (thanks to @LyonessVictims), and with Dutch and Italian subtitles (thanks to the Italian Lyoness Complaint Centre) we gladly announce that the Lyoness video is now also available to Serbian-speakers, for we have received the subtitle file for this video in Serbian.

We are very grateful to ANTIMLM Srbija for providing the subtitles.

The subtitles can be selected by holding the cursor over the video and clicking either 'CC' or 'Subtitles' at the  top of the video. There 'NL' (Dutch), 'EN' (English), SR (Serbian) or 'IT' (Italian) can be selected to match the video and your preferences.

We appeal to the readers of this blog to translate the English subtitle file into their native language or any other language they speak and send it to us - so we can share the truth about Lyoness with even more people worldwide.

You can also download the original video and add your own subtitles.

The Austrian Mafia 7: Lyoness' attempts to obstruct spreading of the truth

Earlier, this Blog has reported on several occasions that people should be aware that Lyoness, its instigators and/or core-adherents seek to obstruct justice by preventing Lyoness victims and/or critics from finding and spreading the truth about Lyoness. One prominent way of doing this has been to deny information-seekers access to critical websites about Lyoness, by actively infiltrating, possessing and controlling core search terms, such as 'Lyoness', 'Lyoness Scam', 'Lyoness Fraud' and 'Lyoness Pyramid Scheme'.

When unwitting or unaware information-seekers insert any of these terms into popular search engines such as Google and Bing, next to a series of variants of the Lyoness main and corporate websites, several obvious propaganda Blogs and websites surface. There is the mind-numbing nonsense of 'islyonessascam' and 'lyonessreviewscamfraud'. There is the clearly independent review of Mr Chris Pickard, who elsewhere claims to be a Lyoness member and to have made a meager amount of money off of this membership - like is common for Lyoness members. And of course, there is Jeanette Hayworth with her truly reprehensible lies developed to prevent anyone looking at Lyoness from forming a proper opinion and making a wise and informed decision.

That, we knew. However, today Plattform-Lyoness reported that Lyoness directors have registered and thus own a substantial amount of domain names that would likely be used to spread the truth about Lyoness (for instance by victims of the Lyoness racket) at some point. In this way, Lyoness makes it considerably harder for critics of their 'company' to reach information-seekers about Lyoness and inform them of the truth. Lyoleaks #2: Lyoness: 'the MLM redemption'?

Recently, the Complaint Centre has been publishing material made and/or spread by high-ranked (former) Lyoness representatives, such as 'Dr.' Rik Wahlrab, highest-ranked Lyoness member in the USA and Mr Craig Wotton, former professional golf player and former managing director of Lyoness Australia.

At first glance, all Lyoness propaganda we have found seems identical, yet when subjected to a closer examination, some differences surface. The most prominent one is that most Lyoness propagandists speak of 'Network Marketing' or 'MLM' when describing the 'business model' of Lyoness, yet the highest-ranked member in the USA, Wahlrab, of whom we think it's fair to expect that he's acquainted with the 'business model', refutes the idea that Lyoness has anything to do with 'MLM' and/or 'Network Marketing'.

In fact, Mr Wahlrab and his 'team' have been spreading propaganda videos and other documents amongst their downline in which they explicitly state that and why Lyoness is absolutely no 'MLM' or 'Network Marketing' company. Here are the arguments they provide for this statement:

The video in which Mr Simsby explains this in further detail, as well as more propaganda and instructions spread amongst American Lyoness members, can be found here:

http://vimeo.com/channels/iappreciateu/56255094 (look for the video 'MLM vs Lyoness')

The just of it all is that Lyoness has at least 13 major advantages over 'MLM' and 'Network Marketing' systems, which, according to Simsby, are 'broken' and 'are only surviving because they have enough workforce to continue adding new members to compensate for the drop out rates'.

While none of that surprises us (given the reputation of 'companies' operating 'MLM' systems) it is quite awkward - to say the least - that a 'company' that claims that its global expansion thrives on the mere concept of replicability, has to sell its 'excellent, unmatched shopping community' under different names and in different disguises in the different countries it operates in.

This is a video spread amongst Lyoness members in other countries than the USA:

Additionally, in all the propaganda material we found and published, as well as in our conversations with non-American Lyoness members, Lyoness is referred to as being 'MLM' or 'Network Marketing'. Some of the propagators have even spread videos detailing what 'Network Marketing' is, why it is the way to 'financial freedom' and why Lyoness is a perfect example of this system. Some of them have instead coined the term 'recommendation marketing' to refer to Lyoness, but according to them, that is 'a distinction without a difference' - used to move the attention of the audience away from the negativity circulation on the Internet about 'Network Marketing'. As regular readers of this Blog may remember, Lyoness members are generally recommended urged to avoid mentioning (next to the term 'Lyoness') 'Network Marketing' or 'MLM' in their contact with new prospects, until a member of the upline is present.

At this point, some of the readers of this Blog may be interested to learn whether we think Lyoness is 'MLM'/'Network Marketing' or not. Our answer is that it does absolutely not matter what we call Lyoness. Lyoness, its instigators and core-adherents have been - and are - operating a pyramid scheme, with related Ponzi schemes and other (advance fee) frauds.

We also know that Lyoness propagators have trained their followers to lie and deceive, and to tailor the lies and deception so that it fits your target audience. This process of tailoring can take place on the level of an individual prospect, but can also be expended to a wider audience, like for instance an entire country or continent.

Except for a some specifically-targeted subgroups, for instance comprising new citizens, everyone in the USA seems to be pretty familiar and fed up with the system sold as 'MLM' or 'Network Marketing', whereas the rest of the world is less experienced in this area. Thus, except for sheltering unprepared prospects from these terms, in the USA, Lyoness has made an extreme effort to avoid association with these terms, even within the organisation and the propaganda material intended for meticulously-brainwashed adherents.

It should be noted that no matter how a fraud is named, disguised or dissimulated - it remains a fraud at any point.

Lawsuit against Plattform Lyoness

The guys over at Plattform Lyoness have received notice that they will be asked to defend themselves in front of an Austrian judge. Obviously, the initiator of the court case is Lyoness - specifically the following people:

- Hubert Freidl
- Tzvetan Wagner
- Monika Murarova
- Alexander Lerch
- Johann Köppling
- Gerald Ernst Seebacher
- Ernst Tuider
- Franz Freidinger

Represented by the Austrian-based lawfirm Piaty, Müller-Mezin & Schoeller, the same firm that owns and registered Lyoness' website in Malta and has registered a number of copyrights and patents on Lyoness logo's, names and slogans around the world.

The Complaint Centre has not had a look at the notice, but concludes based on the writings of 'Plattform Lyoness' that Lyoness is suing them for violating secrecy agreements and publishing internally-distributed, sensitive information and facts about Lyoness. Ironically, it does not seem like Lyoness is contesting the allegations made by the platform. 'Plattform Lyoness', by the way, denies leaking internal company documents to RTL editor Alfred Riehm.

Looks like the panic is rising in Graz and Buchs. They have stopped denying the truth, and started to attack its messengers.

To be continued..

Member indoctrination: what Lyoness does not want you to know (1)

Recently, the Lyoness Complaint Centre came into possession of an email which is sent to American Lyoness members, instructing them on how to recruit new Lyoness members, and more particularly, how to convince their prospects that Lyoness is a viable 'business opportunity'.

As readers of this blog are aware of, Lyoness tries to hide any form of in-depth information about its practices from the world. Therefore, most of the links in the email are only accessible for people in possession of log-in details (which need to be provided by the Lyoness recruiters). However, the Complaint Centre did gain access to a lengthy video presentation about Lyoness, given by the highest ranked Lyoness member in North America, 'Dr.' Rik Wahlrab, a chiropractor from Laguna Niguel, California.

This presentation, by the way, is an official, internal Lyoness presentation - narrated by Wahlrab. It goes a little further than the official Lyoness presentation that is publicly available on the Internet. Furthermore, Wahlrab shows his audience two internal documents which are meticulously hidden from the outside world, namely the American Lyoness income disclosure statement and a document detailing the 'ten ways to make money with Lyoness'.

You can watch the above video and wait until the end for the next part to show up as a recommendation, or you can just click the separate links yourself:

Please, do not forget that the people who get shown this video are 'prepared' by the recruiters - and, therefore, their moods are set right to match the contents of the presentation for maximum chances of persuasion and enrollment in the scam.

Soon this blog will post more about the contents of this video and the other information from the email. Stay tuned. If you do not want to miss anything - subscribe to our email alerts and/or follow us on Twitter!

Share the truth about Lyoness: ORF Report

As reported earlier, the ORF Report broadcast 'The Man Behind Lyoness' has informed many people about the true nature of Lyoness. However, since Lyoness would like to preserve its monopoly on information available about the company to the general public, it has made serious efforts to have the video removed from the Internet, for instance by filing false copyright infringement claims to Youtube.

Luckily, both Plattform Lyoness and @LyonessVictims have recently made an effort to keep the video available for the general public, with the ultimate goal to educate victims, prospects and anyone else looking at the company about its true nature, without Lyoness censoring the information that is provided.

However, the Complaint Centre has received several messages in which people asked for more elaborate English subtitles for the video, as apparently, some of the phrases in the episode were not subtitled. In order to enable others to also subtitle the video in their own language (and share it with people speaking the same language), the Complaint Centre has decided to publish an updated version of the video, fully subtitled in English, as well as a copy of the .srt subtitle file in order to allow people to easily translate the subtitles and update videos with their subtitles.

To start the subtitles, hold the cursor over the video, click 'CC' or 'Subtitles' and select 'EN'.

The original video can be downloaded here.

The subtitle file can be downloaded here.

You can choose to integrate the subtitles in your own video and upload it somewhere, yet you can also just add your subtitles here.

Please, translate and share and let's get this message out there for everyone to see!

Also, share this blog!
